As you may know, Canada's Anti-Spam Legislation (CASL) came into effect on July 1, 2014. CASL’s provisions state that it is an offense to send a commercial electronic message (CEM) without consent, identification information and an unsubscribe link.
Anyone who does not comply with CASL may find themselves in trouble with the Canadian Radio-television and Telecommunications Commission (CRTC), who enforces the legislation through undertakings and fines up to $1 million for an individual or up to $10 million for any other entity.
Because of these significant penalties, it is very important to comply with CASL. This means you may need to review your CEM’s and mailing lists.
So, are you CASL compliant? Review CREA’s CASL compliance materials to find out.
The CRTC also actively enforces the Do-Not-Call List legislation. So, you may also want to refresh your memory by reviewing CREA’s Do-Not-Call List compliance materials found here.
