ICYMI: Canada-wide class action

A Canada-wide class action lawsuit was recently filed naming the Canadian Real Estate Association (CREA) and various regional boards and associations across the country, including CREB®.

This is a group class action that appears to be a broader Canada-wide version of the ongoing Sunderland litigation against Toronto Regional Real Estate Board (TRREB), which proposes that the requirement to offer cooperating compensation to a buyer agent amounts to an anti-competitive agreement to fix, raise, increase or control prices (price fixing).

It’s disappointing and we push back in the strongest possibly way on any claim that suggests our organization was involved in any activity that could be considered anti-competitive.

Nonetheless, as part of our due diligence, we wanted to provide an update to CREB® members and confirm that we will continue to follow this file closely and provide updates and information as we learn more.
