Need-to-know when co-listing with a non-board agent

When listing a property on the MLS® System with a non-REALTOR® agent, think of the following before activating the listing.

Who your agreement is with

A marketing agreement between the non-board brokerage and the CREB® member is not sufficient to postthe property on the MLS® System. In order to post a property on the MLS® System, your brokerage has to have a written service agreement with the person who can transfer interest in the property. In most cases, this would be the owner, who has to sign the listing agreement. However, in some cases it could be a Power of Attorney or Executor/Executrix of the Estate.

Your role as the listing REALTOR®

As the REALTOR® posting the property to the MLS® System, you’re responsible for ensuring information about the property is accurate. You, the REALTOR® and CREB® member who is a part of the cooperative selling system, are also the point of contact, not the non-board member. All inquiries about the property must be directed to you, the CREB® member, or your assistant who is employed by you. 

Having a person who is not a board member listed as a point of contact on the MLS® System presents an issue of accountability. Non-board licensees are not permitted to affiliate themselves with the MLS® and REALTOR® trademarks, which are privileges that only come with CREB® membership. Avoid mentioning non-board listing agents on the MLS® listing as it’s considered misleading. Instead use the showing contact and remarks to encourage interested parties to reach out to you, the REALTOR®, or the seller.

Branding

Listings can’t promote or use materials branded with a non-board brokerage name or contact details. The owner has engaged your services and expertise, which includes your access to the MLS® System. Any branded items on the listing or video links must be for you, the CREB® member who has the rights to be affiliated with the MLS® marks.
